Please, take the time to read the Terms & Conditions of booking set out below prior to booking a boat ride with us. We strongly recommend that you read the entire information relating to your ride, thus ensuring that you understand the services you are interested in.
I. CONTRACT
The contract is between you (The Client/The Customer) and Sports Club Water Motor and Sailing Sports – Vidin (The Company). On booking a tour with The Company, The Client agrees with the Booking Terms & Conditions (which constitute the entire agreement between the two parties) and the booking is accepted on this basis. In case one Client is making a group booking, all group members automatically accept and agree with the Booking Terms & Conditions. The services which are to be provided are the ones cited in the booking confirmation invoice.
II. VALIDITY
Dates of routes and packages are valid as stated in their descriptions. After that dates are indicative only.
III. DEPOSIT REQUIREMENT
The Client is required to pay a non-refundable deposit (see paragraph 7) which is 50% from the total price of the boat ride /tour/ per person and only in this case the booking is confirmed. For tours which cost 25 euro or less per person, 100% of the payment is required. If the booking is made within 10 days of the departure date, then the full amount is payable at the time of booking.
IV. ACCEPTANCE OF BOOKING AND FINAL PAYMENTS
On accepting the booking The Company will issue a confirmation invoice. A contract will exist between The Client and The Company from the date The Company issues the confirmation invoice or The Company registers the payment. The Client may refer to the booking confirmation invoice for details regarding final payments.
* Payment of the balance of the boat ride price is due 10 days before the departure date. If the balance is not paid before the due date, The Company reserve the right to cancel the booking.
* Accepted methods of payment on the Website are:
– Bank transfer
– VISA, MasterCard, Maestro
– PayPal
V. PRICES & SURCHARGES
The boat ride prices are as cited in the offer but might be subject to changeable or seasonal pricing, both of which are normal practice in the industry. This means The Company’s prices may vary in accordance with demand, market conditions, promotions and availability. All prices, given on the Website are in EURO. All payments and transactions will be processed in Bulgarian Leva, which is the official currency in Bulgaria. Rates and charges may vary between different banks and countries.
VI. THE CLIENT’S DETAILS
The Client’s details are required in order for us to confirm the reservation. The details may vary by boat ride. They might include full names by passport, date of birth, nationality, passport number, passport issue and expiry dates, medical insurance, etc.
The Company is also registered in the Register of Personal Data as administrator of personal data.
All your Data is protected by the General Data Protection Regulation of The European Union (GDPR). For further details, please refer to our Privacy Policy.
VII. CANCELLATION BY THE CLIENT
If the cancellation is made by The Client, some cancellation fees will apply. The cancellation will be considered effective when received in written. If The Client cancels a ride or a service:
– 15 days or more prior to departure date, 100% of the paid amount will be returned.
– 8 to 10 days prior to departure date, 50% of the paid amount will be returned.
– 7 оr less days or less prior to departure, no refund.
If The Client fails to join a tour, joins it after departure, or leaves it prior to its completion, no refund will be made.
VIII. CANCELLATION BY THE COMPANY
The Company may cancel a boat ride at any time prior to departure if, due to Force Major (terrorism, natural disasters, political instability or other external events, COVID 19) it is not viable for The Company to operate the planned itinerary. If The Company happens to cancel the boat ride, The Client can transfer amounts paid to an alternate date or receive a full refund. In circumstances where the cancellation is due to external events outside the reasonable control of The Company, refunds will be less any unrecoverable costs. The Company is not responsible for any incidental expenses that The Client may have incurred as a result of The Client’s booking including but not limited to visas, vaccinations, etc.
IX. REFUNDS
The refunds can be only transferred back via the same method of payment. If the payment was made by bank transfer, The Client will receive the payment back on their bank account given. If the payment was made over the virtual POS, The Client will receive the payment back on the same credit/debit card, on which the payment was proceeded. All refunds are paid back after cancellation was accepted and confirmed by The Company during the terms, specified in Article VII and Article VIII of these Terms & Conditions in seven days after the confirmation letter was issued. The money transfer, when payment was made via bank transfer could take some more time, depending on the country of origin and banks’ internal policy.
X. BOOKING AMENDMENTS
Although The Company is flexible and always tries to fulfill The Clients’ wishes, sometimes this opportunity is very limited or excluded. In certain circumstances the Company contracts government institutions, other companies, service providers and agents like restaurants, catering service providers, tour guides, water sports instructors, other boat operators therefore amendments in the booking are not always possible. All details should be clarified by the time The Client receives an email booking confirmation. On a later stage any Amendments, made by The Client, could be not guaranteed by The Company.
XI. INCLUSIONS
Everything, included into the price of the boat ride or package is specified on the website below the relevant boat ride or package. By the time The Client receives an email confirmation of the booking by The Company, there should be information what exactly is included into the price of the boat ride(s).
XII. EXCLUSIONS
On most of our boat rides, The Company has given optional extras like for example – longer stay or overnight at the boat, additional motor our of service, visit a place of interest or port etc., which are not part of the deal, could be paid on spot by The Client. As a general rule and unless otherwise stated, all options and extra services are listed as such, are not included into the price ,and need to be paid on spot by The Client. As this information varies, depending on whether it is a multiday or daily boat ride, promotions, special deals, etc. please refer to the description of the relevant boat ride. Below each of our boat ride and service descriptions is specified what is and is not included. By the time The Client receives a written Confirmation of the booking from The Company, there should be information what exactly is included into the price of the service (s). Anything, not mentioned in the confirmation should be treated as extra and not included into the regular price of the service (s)
XIII. AGE & HEALTH REQUIREMENTS
Most of the boat rides and services offered by The Company have no upper age limit. The Customer must ensure that he/she is fit to allow participation. A clients under the age of 18 or a group of clients must be accompanied by a legal guardian. This could be a parent, a relative, a teacher, etc. who will be responsible for The Customer (s) under the age of days care. People with physical disabilities and medical problems must share that information with The Company before booking our service (s) as in some cases these may not be suitable for every person.
XIV. GROUP REQUIREMENTS
The boat rides, offered by The Company are guaranteed to depart when the requirement for minimum group of customers is met. If The Customer would like to know how many people are booked on specific, he/she needs to inquire that information prior to booking.
XV. PASSPORTS, VISAS, CERTIFICATES
The Client is responsible to ensure that he/she is in possession of the correct visas, permits and certificates for entering the country. The Company is not responsible, in any cases and regardless if boat ride(s) and service(s) are confirmed and customers are charged, if The Client is refused entry to the country because of the lack of the correct passport, visa, vaccination certificate or other needed document or certificate.
XVI. TRAVEL INSURANCE
Travel insurance is obligatory on all of our boat rides abroad. The travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal belongings.
XVII. CHANGE OF ITINERARY
While The Company strives to operate all boat rides as described we reserve the right to change the itinerary.
If The Company happens to make a major change prior departure The Company will inform The Client as soon as possible if there is time before departure. When a major change is made The Client may choose between accepting the change, obtaining a refund of money paid or accepting an alternative tour offered. The Company reserves its right to change an itinerary after departure due to local circumstances or events outside of our control. Please, note The Company is not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.
XVIII. AUTHORITY ON TOUR
The captain is the official representative of the company. The decisions of the captain are final on all matters that might affect the safety or well-being of any Client. If The Client(s) fails to comply with a decision made by the captain, or interfere with the well-being of the group, the captain may discontinue the service(s), direct The Client(s) to leave the boat ride immediately, with no right of refund. The Company may also decide to refuse service to the Client(s) in the future.
XIX. ACCEPTANCE OF RISK
The Client acknowledges that the nature of the boat ride (s) is adventurous and participation involves a certain degree of personal risk. Danube is a mighty river, which can present dangers and physical challenges greater than those present in our daily lives. The Company uses information like weather forecast and own contacts in assessing whether the itinerary should operate. Each boat ride starts with a health and safety instructions briefing and the Client or legal guardian signs a declaration that he/she clearly understands its terms, rules and regulations and is obliged to obey them and obey to the orders of the captain throughout the entire boat ride. The Client acknowledges that their decision to take participation and accept the service is made in light of consideration of this information and The Client/The legal guardian of the client(s) accepts that they are aware of the personal risks attendant upon such a journey.
XX. LIMITATION OF LIABILITY
The Company contracts with a network of companies, government agencies and individuals to assist in the running of the boat rides as agent for these third parties. The Company is not responsible for the acts and omissions of these third parties.
To the fullest extent permitted by law:
– Any liability for any loss, death, injury or damage which The Client may suffer (directly or indirectly) in connection with or arising out of his/her participation in a boat ride, or any breach of the Booking Conditions, is excluded;
– The Client releases The Company and its officers, employees, agents and representatives from any liability and expressly waive any claims The Client may have against The Company arising out of or in connection with his/her participation in a boat ride; and any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.
To the extent an Implied Warranty cannot be excluded, The Company’s liability in respect of the Implied Warranty is limited to (in its absolute discretion): (i) the provision of a similar boat ride or service to an equivalent value; or (ii) a refund of the total amount received by The Company from The Client in connection with The Client’s booking.
Any claim by The Client is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.
XXI. OPTIONAL ACTIVITIES
Optional activities not included in the boat ride are not part of this contract. The Client agrees that any assistance given by the captain or by another company representative in arranging optional activities does not render The Company liable for them in any way.
XXII. CLAIMS & COMPLAINTS
In case The Client has a complaint about the tour he/she must inform the captain or other members of the crew in order that they can attempt to rectify the matter. If satisfaction is not reached through these means, then any further complaint should be sent in written to The Company by post or email.
XXIII. PHOTOS AND MARKETING
The Client agrees that The Company has the right to use images of him/her, taken during the for advertising and promotional purposes in any medium it chooses. The Client allows The Company to use such images for publicity and promotional purposes.
